LICENSED APPLICATION END USER LICENSE AGREEMENT

This End User License Agreement (“EULA”) is a legal agreement between you and Explore To Win / Indite Publishing LLC (“Licensor”) concerning the use of the application Aprender Inglés - Indite Media (the “Licensed Application”).By downloading or using the Licensed Application, you agree to be bound by this EULA.This EULA is concluded between you and the Licensor, not Apple. Licensor is solely responsible for the Licensed Application and its content.1. AcknowledgementYou and the Licensor acknowledge that this EULA is between you and the Licensor only, not with Apple. The Licensor is solely responsible for the Licensed Application and its content. This EULA must not conflict with the Apple Media Services Terms and Conditions.2. Scope of LicenseYou are granted a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, in accordance with the Apple Media Services Terms and Conditions and Usage Rules. Family Sharing and volume purchase are supported if enabled.3. Maintenance and SupportThe Licensor is solely responsible for providing maintenance and support for this Licensed Application. Apple has no obligation to provide any maintenance or support services.4. WarrantyLicensor is solely responsible for any warranties related to the Licensed Application, whether express or implied. In the event of failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if applicable. To the extent permitted by law, Apple has no other warranty obligations regarding the Licensed Application. All other claims and responsibilities fall to the Licensor.5. Product ClaimsLicensor, not Apple, is responsible for addressing any claims you or any third party may have relating to the Licensed Application or your use or possession of it. This includes but is not limited to:
- Product liability claims
- Claims that the Licensed Application fails to comply with legal or regulatory requirements
- Claims arising under consumer protection, privacy, or similar legislation (including use of HealthKit or HomeKit if applicable)6. Intellectual Property RightsIn the event of any third-party claim that the Licensed Application or your use of it infringes a third party's intellectual property rights, Licensor is solely responsible for the investigation, defense, settlement, and discharge of such claim.7. Legal ComplianceYou represent and warrant that:
- You are not located in a country subject to a U.S. Government embargo, or designated as a “terrorist supporting” country.
- You are not listed on any U.S. Government list of prohibited or restricted parties.8. Developer Name and AddressExplore To Win / Indite Publishing LLC

Third-Party Terms of AgreementYou agree to comply with all applicable third-party terms of agreement when using the Licensed Application (e.g., wireless data service agreements if using a VoIP feature).10. Third Party BeneficiaryYou and the Licensor acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.Additional Terms from LicensorThis EULA applies to the app Aprender Inglés - Indite Media by Explore To Win / Indite Publishing LLC.All rights not expressly granted are reserved by Licensor. Use of the Licensed Application is at your own risk.
